1. Acceptance of Terms
By accessing or using the services provided by Strive Health Telemedicine PLLC ("Strive Health," "we," "us," or "our"), including but not limited to our website, mobile applications, and virtual medical consultations (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use the Services.
2. Nature of Telemedicine Services
2.1. Informed Consent: You acknowledge and agree that you are receiving healthcare services remotely via telemedicine. Telemedicine involves the use of electronic communications to enable healthcare providers at Strive Health to communicate with you about your health condition and treatment plan.
2.2. Limitations: You understand that the Services may not be suitable for all medical conditions or emergencies. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 IMMEDIATELY OR PROCEED TO THE NEAREST EMERGENCY ROOM.
2.3. Provider-Patient Relationship: Your use of the Services does not automatically create a provider-patient relationship. This relationship is only established upon acceptance of your treatment request by Avril Parker APRN, PMHNP, AGPCNP, or another licensed Strive Health provider, and your explicit agreement to the informed consent process.
3. Eligibility and Account Use
You must be at least 18 years of age and legally capable of entering into a contract to use the Services. You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account.
4. Financial Terms and Billing
4.1. Fees: You agree to pay all fees and charges associated with the Services as described on our website at the time of service, including co-pays, deductibles, and cash prices for services not covered by insurance.
4.2. Insurance and Payment: While Strive Health may assist with insurance claims, you are ultimately responsible for ensuring payment of all professional fees. Strive Health may charge a processing fee for returned checks or declined credit card payments.
4.3. Refunds: All payments are non-refundable, except at the sole discretion of Strive Health or as required by applicable law.
5. Privacy and Security
Your Protected Health Information (PHI) is protected under the Health Insurance Portability and Accountability Act (HIPAA). Our practices for handling your PHI are detailed in our Notice of Privacy Practices (NPP), which you must review and agree to. Your use of this website is also governed by our general Privacy Policy.
6. Prescription Policy
6.1. Provider Discretion: Prescriptions are issued at the sole discretion of the Strive Health provider. There is no guarantee that a specific medication, including but not limited to controlled substances or lifestyle medications (e.g., Testosterone, Sildenafil), will be prescribed.
6.2. Electronic Prescriptions: Prescriptions will be submitted electronically to your designated pharmacy.
7. Intellectual Property
All content on the Strive Health website and platforms, including text, graphics, logos, and software, is the property of Strive Health Telemedicine PLLC or its content suppliers and is protected by copyright laws. You may not use, reproduce, or distribute any content without our express written permission.
8. Disclaimers and Limitation of Liability
8.1. Medical Advice Disclaimer: The information provided on our website (including the Blog) is for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your provider or other qualified health professional with any questions you may have regarding a medical condition.
8.2. Limitation of Liability: To the fullest extent permitted by law, Strive Health Telemedicine PLLC, its providers, officers, directors, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with your use of the Services, whether based on warranty, contract, tort (including negligence), or any other legal theory.
9. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Hawaii, without regard to its conflict of law principles.
